Litigation & Dispute Resolution

Overview

C. Topouzis & Associates provides robust representation in civil and commercial litigation before all levels of the Cyprus court system, as well as in arbitration and alternative dispute resolution proceedings. In practice since 2017, including at leading Nicosia law firms, our team has the depth of knowledge and practical skill required to handle complex, high-stakes disputes.

The Cyprus legal system is based on English common law principles, with a well-established framework of civil procedure rules, an independent judiciary, and strong enforcement mechanisms. We leverage this system to protect our clients’ rights and achieve effective outcomes, whether through negotiation, mediation, arbitration, or trial.

Civil & Commercial Litigation

We represent clients in a broad range of civil and commercial disputes before the District Courts, the Commercial Court, and the Supreme Court of Cyprus. Our experience covers:

  • Breach of contract and commercial disputes
  • Shareholder and partnership disputes
  • Breach of fiduciary duty and derivative shareholders’ claims
  • Professional negligence claims
  • Tortious liability and damages claims
  • Fraud and conspiracy claims
  • Banking and financial disputes
  • Insolvency, winding-up applications and debt recovery proceedings

We handle each matter with thorough preparation, strategic planning, and a clear focus on achieving the most favourable outcome for our clients within realistic timeframes and budgets.

Arbitration & Alternative Dispute Resolution

Not all disputes are best resolved through the courts. We advise on and represent clients in domestic and international arbitration proceedings, including under the rules of the Cyprus Centre for Alternative Dispute Resolution and other international arbitration bodies. We also assist with mediation and other forms of alternative dispute resolution, which can offer faster, more cost-effective, and confidential resolution of disputes.

Our services include drafting arbitration clauses, representing clients in arbitral proceedings, and advising on the enforcement of arbitral awards under the New York Convention, to which Cyprus is a signatory.

Interim & Protective Measures

In urgent matters, we act swiftly to obtain interim and protective relief, including:

  • Injunctive orders (prohibitory and mandatory)
  • Freezing orders (Mareva injunctions) over assets in Cyprus and abroad
  • Chabra (third-party) freezing relief and asset-tracing claims
  • Norwich Pharmacal and ancillary disclosure orders
  • Anton Piller orders for preservation of evidence
  • Interim attachment and receivership orders
  • Urgent applications for the preservation of rights pending trial

We understand that in many disputes, the speed and effectiveness of interim measures can be decisive. Our team is experienced in preparing and presenting urgent applications at short notice.

Enforcement of Judgments & Awards

We assist clients in enforcing domestic and foreign judgments and arbitral awards in Cyprus. As an EU member state, Cyprus is subject to the Brussels I Regulation (Recast), which facilitates the recognition and enforcement of judgments from other EU member states. We also advise on the enforcement of judgments from non-EU jurisdictions under bilateral treaties and the common law rules of private international law.

Our Approach

Litigation is not an end in itself. We approach every dispute with a clear strategy focused on our clients’ commercial and personal objectives. Where possible, we seek efficient resolution through negotiation or settlement. Where litigation is necessary, we pursue it with determination, thorough preparation, and effective advocacy. We maintain open and transparent communication with our clients throughout the process, ensuring they are informed and involved at every stage.
